Tribunal's reasoningThe tribunal upheld the claimant's section 23(1) Employment Rights Act 1996 complaint and found that Archangel Ltd had made unlawful deductions from wages between 24 February 2021 and 10 March 2021, contrary to section 13 ERA. It accepted that the claimant had been underpaid £100.08 in respect of wages paid on 24 February 2021 and a further £46.14 in relation to the 3 March 2021 payment, making a total unlawful deduction of £146.22.
The tribunal also found that the claimant was unfairly dismissed. It awarded a basic award of £495, calculated under section 119 ERA, and a compensatory award of £400 under section 123 ERA. In the reasons given for the compensatory award, the tribunal recorded that there was no award for loss of earnings because the claimant obtained nil alternative employment immediately on termination at a commensurate rate of pay, and the £400 was for loss of statutory rights.
