Tribunal's reasoning

At the hearing on 14 March 2019 before Employment Judge Dean, the tribunal held that the claimant was employed by the first respondent at the relevant time. It also recorded that the claimant's complaints against the second respondent were withdrawn and dismissed.

The claimant applied to strike out the respondent's response on the basis that it had no reasonable prospect of success, but that application did not succeed. The tribunal nevertheless found that the first respondent's response had little reasonable prospect of success for the purposes of rule 39(1).

As a result, the tribunal ordered the first respondent to pay a deposit of £1,000 in respect of each relevant complaint, namely automatically unfair dismissal and unlawful discrimination on the ground of pregnancy. This was a procedural decision and did not determine the substantive merits of those complaints.
