Tribunal's reasoningAt a hearing in Birmingham by CVP on 19 September 2024, Employment Judge Edmonds considered whether the respondent had made unlawful deductions from the claimant's wages for days in March and April 2023. The tribunal found that on the dates when the claimant was not contactable and/or did not follow the respondent's standard reporting procedure by contacting the central team on 0330 123 5215, he was not ready, willing and able to work. It also found that the absence reporting requirements in clause 11 of the contract applied whether the absence was due to sickness or some other reason, and that if those procedures were not followed the respondent was entitled to treat the absence as unauthorised and not to pay for that day.
The tribunal further found that on dates in March and April 2023 when the claimant said he could not work because he did not have a working PC, he was ready, willing and able to work. Overall, however, it held that the respondent was entitled to make deductions from wages on any days when the claimant was not ready, willing and able to work during March and April 2023, at the rate of one day's pay for each day in question, because those deductions were authorised by the written terms of the contract of employment. The claim therefore did not succeed.
