Tribunal's reasoningThe claimant, Miss T Makawa, applied for interim relief under section 129 Employment Rights Act 1996. At the preliminary hearing in Birmingham on 27 June 2024, Employment Judge Childe recorded that the application succeeded.
The respondent stated at the hearing that it was unwilling either to reinstate or re-engage the claimant. In those circumstances, the tribunal ordered the continuation of the claimant's contract of employment. The contract was to continue in force for pay and other employment-derived benefits, including seniority and pension rights, and for continuity of employment until the determination or settlement of the complaint.
By agreement, the respondent was to pay the claimant £2,166.67 gross per month by way of pay, on the last working day of each month. The judgment also records that a gross payment of £4,000 made to the claimant on 28 June 2024 under her contract as payment in lieu of notice went towards discharging the respondent's liability under the pay order.
