The claimant, Mr M Mussell, was dismissed for redundancy on 23 September 2019 after 44 years' continuous employment with the respondent, Mrs D Taylor t/a A J Virgo Monumental Masons. He brought claims for a statutory redundancy payment, three weeks' unpaid wages, and three weeks' accrued but unpaid holiday pay, heard at a preliminary hearing by telephone in Birmingham before Employment Judge Lloyd on 13 May 2020.

The respondent said she had posted an ET3 but the tribunal had no record of receipt. At the hearing she stated unequivocally that she did not defend or dispute the claimant's claims. She did not dispute the claimant's gross weekly wage of £480 or his length of service, and she apologised for the distress caused by the loss of his job and the failure to pay the sums due.

The tribunal awarded the statutory redundancy payment using the Government's online calculator and the accepted weekly pay figure of £480. It found the claimant had proved his claim for three weeks' unpaid wages and his claim for three weeks' accrued holiday pay. The amounts awarded were £14,160 for redundancy, £1,440 for unpaid wages, and £1,440 for holiday pay, producing a total award of £17,040.
