Key findings
Tribunal's reasoningAt Birmingham by CVP on 18 and 19 March 2021, before Employment Judge Miller, the tribunal held that Mrs C Pikes was unfairly dismissed and that the dismissal was also in breach of contract. Those claims were found to be well founded and successful.
The tribunal also upheld the claim for unpaid holiday pay on termination under regulation 14 of the Working Time Regulations 1998. In addition, it found that the claimant had not been given itemised pay statements containing the particulars required by section 8(2)(e) of the Employment Rights Act 1996.
The tribunal further found, for the purposes of section 38 Employment Act 2002, that at the date proceedings started the respondent was in breach of the duty under section 4 Employment Rights Act 1996 to give a written statement of particulars under section 1 Employment Rights Act 1996. Remedy was not determined in this judgment and was listed for a separate hearing on 28 May 2021.
