Tribunal's reasoningAt a video hearing before Employment Judge J Connolly on 17 July 2025, the respondent accepted that the complaints addressed in this judgment were not contested or disputed. On that basis the Tribunal found the claimant's complaint of unauthorised deductions from wages in respect of unpaid salary for the period 1 January 2024 to 30 August 2024 to be well-founded, and ordered the respondent to pay £16,473.88 as the gross sum deducted.
The Tribunal also found the holiday pay complaint well-founded, on the basis that the respondent had failed to pay the claimant for holidays accrued but not taken at the end of her employment, and ordered payment of £1,266.67. The breach of contract complaint in relation to an unpaid pension contribution was likewise well-founded, with damages of £1,168.67 awarded. The total sum payable under the judgment is £18,909.22, and the Recoupment Regulations do not apply.
The judgment expressly records that two further complaints remain outstanding and were not determined: a complaint of unfair constructive dismissal and a complaint of unauthorised deduction from wages or breach of contract in respect of an unpaid tax rebate from the 23/24 tax year. These have been postponed and relisted under a separate Case Management Order. Reasons were given orally and written reasons were not requested.
