By letter dated 25 October 2018, the Tribunal gave each respondent an opportunity to make representations, or request a hearing, on why its response should not be struck out for not having been actively pursued. The respondents did not make representations in writing, did not make sufficient representations, and did not request a hearing.

Regional Employment Judge Pirani therefore struck out the response on behalf of each respondent on 8 November 2018. The judgment did not determine the merits of the claimant's underlying case.

The Tribunal recorded that the respondents would still receive notice of any hearings and decisions, but would only be allowed to participate to the extent permitted by the Employment Judge. The case remained listed for 14 March 2019, the hearing time was reduced to three hours, and the claimant was directed to file an updated schedule of loss within 14 days.
