On the wages claim, the tribunal accepted Mr Nowak's evidence and his payslips, and found that he had not been paid £1,648.64 shown on his October 2021 payslip and £600 shown on his November 2021 payslip.
The tribunal also found that £250 recorded on an August payslip remained unpaid, even though that payslip was not produced. It was satisfied that the total unpaid wages were £2,498.64 and ordered that amount to be paid. The tribunal noted that the payslips recorded deductions for NI and PAYE, so the award was ordered to be paid in full without deduction.
The holiday pay claim, brought under regulation 30(1) and referring to regulation 14(2) of the Working Time Regulations 1998, was dismissed on withdrawal. No separate monetary award was made for that claim.
