The tribunal held that there was no transfer of undertaking between the Claimant or Moneythatworks Ltd, on the one hand, and the Respondent, on the other.
On that basis, the tribunal found that the Claimant’s continuity of employment with the Respondent ran only from 1 June 2019 to 1 December 2020. It followed that he did not have sufficient service to bring claims for unfair dismissal or a statutory redundancy payment.
Both the unfair dismissal claim and the claim for a statutory redundancy payment were therefore dismissed at this stage. The tribunal noted that the full merits hearing of the remaining claims would take place by video on 16 to 18 January 2023. No monetary award was made in this judgment.
