Tribunal's reasoningThe claimant worked in the respondent's accounts department for 6 hours a day, 3 days a week at an hourly rate of £12.82. She started work on 20 March 2017 and was summarily dismissed by email on 29 September 2017. The respondent had alleged in correspondence that the claimant's CV contained untruths, but did not attend the hearing and did not prove the asserted misconduct.
The tribunal found that the claimant was not in breach of contract when dismissed, so the dismissal was in breach of contract for notice pay purposes. As the contract provided for one week's notice during the probationary period, the claimant was awarded £230.76 in lieu of notice.
The tribunal accepted the claimant's evidence and calculations on the remaining money claims. It awarded two days' holiday pay, four days' overtime at the normal hourly rate, and statutory sick pay calculated using the Government SSP calculator. The tribunal directed the sums to be paid gross, with the claimant to account to HMRC for any tax or National Insurance due.
