Tribunal's reasoningAt Bristol on 1 and 2 May 2019, Employment Judge Street determined a TUPE preliminary issue in favour of the claimants. The tribunal found that there was a business transfer of the lettings business known as Hamlet from the first respondent, Mr Ian J Gahan trading as Hambledon Estate Agents, to the second respondent, Hamlet South West Ltd.
The tribunal further found that the claimants were assigned to the economic entity that transferred, and that the effect of the business transfer was that their contracts of employment transferred to the second respondent on 3 April 2018, or no later than 4 April 2018. It also found that the claimants were affected employees for the purposes of information and consultation under TUPE.
