Tribunal's reasoningThe Tribunal struck out the Claimant's complaint of unfair dismissal under s.104 of the Employment Rights Act 1996. The reason given was that the Claimant had been ordered to pay a £1,000 deposit after a preliminary hearing on 2 January 2020, the order was sent on 11 February 2020, and the deposit had not been paid. The Tribunal therefore applied rule 39(4) of the Employment Tribunals Rules of Procedure 2013.
The Judgment did not dispose of the separate complaint under s.103A, and it recorded that the hearing fixed for 6, 7 and 8 July 2020 was unaffected because the Tribunal still had to determine that complaint. No monetary award was made in this Judgment.
