Tribunal's reasoningOn 26 November 2021 Employment Judge Smail ordered the claimant to provide further information about each event, act or failure complained of and said to have been influenced by race, disability, age, and religion or belief. The order required dates or approximate dates, the names of the people responsible, what was said or done, and whether the claimant could identify a comparator treated differently in similar circumstances. The claimant was also directed to provide the further and better particulars requested in paragraph 43 of the ET3 grounds of resistance.
The claimant did not comply with that order by the deadline of 10 December 2021. He was ordered again on 17 January 2022 to provide the same information by 24 January 2022, but again did not do so. The tribunal found that the claims were therefore not being actively pursued.
The judgment, sent to the parties on 4 February 2022, struck out the claims on that basis. No merits findings or financial remedy were recorded in the judgment.
