Tribunal's reasoningMrs Griffiths brought a monetary claim for breach of contract against Phoenix SW Limited arising from the ending of her employment. She began work on 28 February 2021, moved to a new role on 6 July 2021, and gave four weeks' notice on 29 July 2021 to expire on 27 August 2021. During that notice period, the respondent terminated her contract on 3 August 2021 with two weeks' notice to expire on 16 August 2021 and paid her in lieu of notice, so her employment ended immediately.
The claimant sought payment for the period from 16 August 2021 to 27 August 2021. The tribunal found that her contract provided for four weeks' notice except during the probationary period, when only two weeks' notice was required. It held that the respondent's two weeks' notice was therefore in accordance with the contract, that the claimant's earlier notice did not prevent the respondent from later giving notice, and that payment in lieu of notice was permitted.
On that basis, the tribunal found there was no contractual requirement to pay the claimant after 16 August 2021 and no breach of contract. The claim was dismissed.
