At the public video hearing on 12 October 2022 before Employment Judge C H O’Rourke, the tribunal recorded that the claimant's victimisation on grounds of race claim and her unlawful deductions from wages claim were dismissed upon withdrawal. The judgment does not record any merits findings on those two claims.

The tribunal also dealt with the claimant's application for relief from sanctions under Rule 38 in relation to an earlier order of 19 August 2022 which had dismissed her unfair dismissal claim. Relief was granted because it was in the interests of justice to do so: the tribunal had mistakenly treated the related unless order of 26 July 2022 as applying to the unfair dismissal claim when it in fact referred to the victimisation claim.

The order of 19 August 2022 was therefore set aside. No monetary award was recorded in the judgment.
