Tribunal's reasoningOn 24 September 2021 the claimant attended a virtual meeting with the first respondent's administrators and was told, by a script read over a black screen, that she was dismissed by reason of redundancy with immediate effect. The tribunal recorded that the administrators had been appointed on 22 September 2021, employees were informed on 23 September 2021, and 73 employees, including the claimant, were dismissed at 9am on 24 September 2021. The tribunal accepted that no consultation process was undertaken over the redundancy dismissals.
In respect of the redundancy consultation claim, the tribunal made a Protective Award under s182 of the Employment Rights Act 1996 and ordered the first respondent to pay 30 days' pay, assessed at £5,384.62. The reasons record that the claimant was one of a group of between 25 and 100 employees dismissed at the same time, and that the first respondent accepted there had been no consultation.
The claimant also claimed unpaid salary for 1-24 September 2021. The tribunal accepted that she had been paid for August 2021 but not for September 2021, and noted that the Secretary of State had paid £1,515.16 net in respect of those unpaid wages under s184 of the Employment Rights Act 1996. After giving credit for that payment, the tribunal ordered the first respondent to pay the remaining balance of £3,330.99. The judgment also notes that it was the judgment required under s185(b) for the Secretary of State to pay the Protective Award to the claimant.
