Tribunal's reasoningAt a preliminary hearing in Bristol by CVP on 19 October 2020, Employment Judge Halliday found that the Third Claimant was not a disabled person within the meaning of section 6 and schedule 1 to the Equality Act 2010 at any time material to the claim. The Third Claimant's disability discrimination claim was therefore dismissed.
The First, Second and Third Claimants withdrew their claims for detriment under section 47B Employment Rights Act 1996, and those claims were dismissed on withdrawal. The Third Claimant also withdrew his claim for a redundancy payment, which was dismissed on withdrawal.
The Respondent's application to strike out the claims brought by the First, Second and Third Claimants under sections 44, 100, 10 and 103A ERA 1996 on the basis that they had no reasonable prospects of success was refused.
