Tribunal's reasoningThe tribunal found that both claimants were employees of the First Respondent, Moor Electrical Limited (in Creditors Voluntary Liquidation), from 29 June 2010 until 11 May 2023, when they were made redundant. On being made redundant they were entitled to statutory redundancy payments under s.135 Employment Rights Act 1996 and statutory notice pay under s.86 Employment Rights Act 1996.
The First Respondent did not attend and was not represented, and had failed to make the payments owed. The tribunal held that the claimants were therefore entitled to claim those payments from the Second Respondent, the Secretary of State for Business and Trade, pursuant to ss.166 and 182 Employment Rights Act 1996, and that the claims against the Second Respondent were well founded.
The Second Respondent was ordered to pay Mr Graham Jones £3,408.30 statutory redundancy pay and £2,272.20 statutory notice pay, and Mr Marc Jones £3,095.95 statutory redundancy pay and £2,751.92 statutory notice pay.
