Tribunal's reasoningBy a claim form dated 12 November 2023, Ms Lowe alleged unlawful deductions from wages, saying she had not been paid for two and a half hours of work completed on 26 September 2023. The tribunal recorded that ACAS contact had been made on 7 November 2023 and that a certificate was issued on 9 November 2023, so the claim was within time.
The judgment notes that Ms Lowe referred in her claim form to Micheal Isaiah and did not name Goshen Multiservices Ltd, although the claim was issued against Goshen Multiservices Group Ltd. Mr Isaiah resisted the claim and said the correct employer was Goshen Multiservices Ltd, of which he was no longer a director.
Ms Lowe did not attend the final hearing listed for 5 April 2024. The tribunal was satisfied that the notice of hearing had been correctly served by post and email to the contact details provided on the claim form, and that the tribunal had not been notified in advance of any reason for her non-attendance.
