Tribunal's reasoningAt the video hearing on 15 June 2021, with the respondent not attending and no response entered under Rule 21, Employment Judge Gray held that Mr Gallimore had suffered unauthorised deductions from wages both as a worker and as an employee. The tribunal also found that he was constructively dismissed and that the dismissal was unfair because the principal reason was his making of a qualifying protected disclosure.
The tribunal awarded £281.25 for worker wages, £1,618.20 and £2,092.50 for employee wages, and £11,508.75 by way of compensatory award. It also awarded £400 for personal work equipment lost as a result of dismissal and £1,395 for failure to provide written particulars of employment, making a total monetary award of £17,295.70.
The compensatory award was subject to the Recoupment Regulations 1996.
