Tribunal's reasoningThe tribunal held that it was not reasonably practicable for the claimant to bring the breach of contract and Working Time Regulations claims within the prescribed period, and that it was reasonable for him to present the claim by 20 December 2020. On that basis, those claims were treated as in time.
On the redundancy issue, the tribunal found that Mr A Johnson was made redundant on 31 July 2020 in accordance with section 138 Employment Rights Act 1996. It therefore ordered K & B Snook Ltd to pay the statutory redundancy payment of £5,330.75.
The tribunal also found that the respondent breached the claimant’s contract by dismissing him without notice. It awarded £2,746.10 net for breach of contract by way of notice pay.
In addition, the tribunal ordered payment of £545.29 net under the Working Time Regulations 1998 for accrued but unpaid holiday pay. The total sum awarded across the claims was £8,622.14.
