Tribunal's reasoningBy consent, the claimant was treated as a disabled person within s.6 Equality Act 2020. The tribunal found that the respondent did not know, and could not reasonably have been expected to know, that he was disabled before 8 February 2022, but knew of his disability from that date. The claimant's dismissal on 17 February 2022 was found to be both direct disability discrimination and unfavourable treatment arising from disability.
The claimant's claims that the respondent had made unauthorised deductions from wages and/or breached his contract by failing to pay Statutory Sick Pay were dismissed upon withdrawal by the claimant. The tribunal also recorded that the respondent had failed to provide written particulars of employment.
On remedy, the parties reached agreement as to quantum in the sum of £10,000, but not as to a payment schedule. The tribunal therefore entered judgment by consent requiring the respondent to pay £10,000 in settlement of the liability judgment above.
