Paul Theuma [1] Callum Locke [2] Michael Williams [3] v Eva-Lution Property Services Limited — 2023

At a hearing in Cardiff on 27 July 2023 before Employment Judge H J Randall, the Respondent did not attend. The written judgment records that Paul Theuma, Callum Locke and Michael Williams were dismissed from the Respondent’s employment on 31 January 2023.

For each claimant, the tribunal found an unauthorised deduction from wages and ordered payment of the gross sums of £10,050 to Mr Theuma, £9,648 to Mr Locke and £8,140 to Mr Williams. The tribunal also found each claimant was dismissed in breach of contract in respect of notice, with awards of £750, £720 and £600 respectively.

The tribunal further found that each claimant had accrued annual leave which had not been taken at dismissal and ordered payment of gross sums of £375, £360 and £300. The total compensation payable was recorded as £11,175 for Mr Theuma, £10,728 for Mr Locke and £9,040 for Mr Williams. The judgment also states that the claimants are responsible for any income tax or employee national insurance contributions due on the sums awarded.
