The tribunal dealt only with limitation and jurisdiction. It found that the claimant’s constructive unfair dismissal claim, her automatic constructive unfair dismissal claim described as whistleblowing, and her public interest disclosure claim were all filed out of time. For those claims, the tribunal held it was reasonably practicable for them to have been served in time, so it dismissed them for want of jurisdiction.

The tribunal also considered the claimant’s indirect sex discrimination claim. It found that claim was filed out of time and that it was not just and equitable to extend time. That claim was therefore also dismissed for want of jurisdiction.
