In each case, the tribunal found that the first respondent had failed to comply with section 188 TULRCA.
The tribunal ordered a protective award under section 189(3) of TULRCA for the first and second claimants, equivalent to remuneration for the period of 90 days beginning on 2 March 2023. It also ordered a protective award for the former employees of the first respondent at its Capel Hendre, Ammanford site who were dismissed on or after 2 March 2023 and in respect of whom the claimant trade union was recognised for collective bargaining, again for a period of 90 days beginning on that date. The Employment Protection (Recoupment of Jobseeker's Allowance and Income Support) Regulations 1996 were held to apply to the award.
