The tribunal found the first and second claimants' complaints under section 189(1)(d) of the Trade Union and Labour Relations (Consolidation) Act 1992 well founded, and found the third claimant union's complaint under section 189(1)(c) of the same Act well founded. In each case, the tribunal found that the first respondent had failed to comply with section 188 TULRCA.

The tribunal ordered a protective award under section 189(3) of TULRCA for the first and second claimants, equivalent to remuneration for the period of 90 days beginning on 2 March 2023. It also ordered a protective award for the former employees of the first respondent at its Capel Hendre, Ammanford site who were dismissed on or after 2 March 2023 and in respect of whom the claimant trade union was recognised for collective bargaining, again for a period of 90 days beginning on that date. The Employment Protection (Recoupment of Jobseeker's Allowance and Income Support) Regulations 1996 were held to apply to the award.
