The tribunal heard the claimant's oral evidence and found that his dismissal without notice on 20 March 2023 entitled him to statutory notice pay. It ordered the respondent to pay one week's notice pay in the net sum of £534, and recorded that the respondent was liable to HMRC for any tax and national insurance due on that payment.

The tribunal also found that, at the date of dismissal, the claimant was owed 4.5 days of holiday pay. It upheld that claim and ordered payment of £480.60 net, again noting that the respondent would be liable to HMRC for any tax and national insurance on that award.

In addition, the tribunal found that the respondent had failed to provide the claimant with written terms of employment before his dismissal. The employment had commenced on 1 May 2021, and the tribunal made an award under section 38 of the Employment Act 2002 of 4 weeks' net pay, amounting to £2,136. The total sum payable under the judgment was £3,150.60, to be paid by 4pm on 4 December 2023.
