Tribunal's reasoningAt a hearing on 24 February 2020 before Employment Judge Howden-Evans, sitting alone, there was no attendance by or on behalf of the respondent. The tribunal heard evidence from Mr Pugh and Mrs Rogers and recorded that the correct name of the respondent was The Cleaning People Facilities Limited, which had gone into voluntary liquidation.
The tribunal found that the respondent had dismissed both claimants on grounds of redundancy. It then awarded Mr Pugh £680 gross for outstanding wages and £238 gross for unpaid holiday pay, making £918 in total. It awarded Mrs Rogers £680 gross for outstanding wages and £204 gross for unpaid holiday pay, making £884 in total.
The judgment stated that the claimants were responsible for any income tax or employee National Insurance contributions due on the wage and holiday-pay sums. It also noted that, because the respondent was in voluntary liquidation, recovery from the respondent was likely to be difficult and that if the debts could not be recovered they could claim payment from the National Insurance Fund under section 166(1)(a) Employment Rights Act 1996. The tribunal said that the Employment Protection (Recoupment of Jobseekers Allowance & Income Support) Regulations 1996 did not apply to the award.
