Tribunal's reasoningThe tribunal found that the complaint that Tomlinson’s Dairies Ltd, in Administration, failed to comply with a requirement of section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992 was well founded. The respondents did not attend the hearing.
A protective award was made in respect of all employees of the First Respondent who had brought a claim in these proceedings, were assigned to work at the Five Crosses Industrial Estate and Vauxhall Industrial Estate establishments, and were dismissed as redundant on or after 14 October 2019. The First Respondent was ordered to pay those employees remuneration for a protected period of 90 days beginning on 14 October 2019.
The tribunal also recorded that the claims brought by the claimants listed in Appendix 2 were dismissed following withdrawal. The judgment stated that it did not prevent a claim being made to the Second Respondent for payment from the National Insurance Fund in respect of the First Respondent’s liability.
