Tribunal's reasoningOn 4 August 2021 Regional Employment Judge S Davies struck out Ms K Thomas's claim against Countrywide Tax Returns Ltd. Before doing so, the tribunal had written to the claimant by letter dated 23 July 2021 giving her an opportunity to make representations or request a hearing as to why strike-out should not follow, because she had not complied with the case management orders of Employment Judge Jenkins dated 9 February 2021, including paragraphs 2, 4, 6, 12, 14, 17, 19 and 26.
The tribunal also recorded that the claimant had not responded to correspondence dated 13 July, 23 July and 2 August 2021, and that the claim had not been actively pursued. The claimant made no written representations, or none that were sufficient, and did not request a hearing in response to the tribunal's warning.
The tribunal therefore struck out the claim. The hearing listed for 5 and 6 August 2021 did not take place. The judgment does not record any merits findings or any remedy award.
