Tribunal's reasoningThis was Ms E Bulmer's complaint of unauthorised deduction from wages against Shine Bright Day Care and Out of School Club Ltd. The tribunal found that the respondent had not paid all but £400 of her September and October 2022 wages, leaving £2,597.50 net outstanding. That element succeeded under s.13 Employment Rights Act 1996.
The main dispute was whether Ms Bulmer remained employed into November and December 2022. The tribunal accepted her evidence that she was working at the premises or from home with Ms A McDonald's knowledge or express or implied agreement until the weekend of 3/4 December 2022. It found there had been no express dismissal, and held that the employment ended when Ms Bulmer accepted the respondent's fundamental breach in failing to pay wages. Her last working day was 2 December 2022.
For November and December 2022, the tribunal found that she was owed one month's wages less two sickness days, subject to a deduction for five days' annual leave taken in excess of accrued entitlement. After the contractual holiday deduction and tax/National Insurance calculations, the net amount due for that period was £1,193.92. The tribunal also awarded £6.45 for late payment charges on direct debits supported by bank statements, and ordered the September/October arrears to be paid net with tax and National Insurance due separately.
