Employment Judge Lancaster amended the respondent's name to Accepted Money Limited and found that, apart from Miss Smith who had resigned earlier, the claimants were dismissed by reason of redundancy on 28 February 2023. The respondent did not attend the hearing.
For Miss Rook, the tribunal upheld claims for unauthorised deductions from wages in respect of unpaid salary for January and February 2023 and awarded £3,500. It also upheld a claim for unpaid accrued contractual holiday entitlement and awarded £323.08 for 4 days' holiday.
The tribunal further upheld a contractual claim arising from pension deductions. It found that employee pension contributions deducted from salary and intended for the Nest pension scheme had not been paid over, in breach of the implied term of contract that the monies would be dealt with in that way, and awarded Miss Rook £196.80.
The judgment stated that redundancy payments succeeded only for claimants with 2 years' qualifying service. No redundancy payment was awarded to Miss Rook. The total sum ordered to be paid to her was £4,019.88 gross. All other claims were dismissed.
