Tribunal's reasoningBefore Employment Judge JM Wade, sitting with lay members Mr W Roberts and Mr M Taj, the tribunal heard the appellants' challenge to notices N-TBS-300123-01 and N-TBS-300123-01A served on 30 January 2023 by Tania Bernice Shiffer, one of His Majesty's Inspectors of Health and Safety. The tribunal unanimously held that the notices should be affirmed, subject to limited textual modifications.
The modifications were specific. In notice 300123-01A, the tribunal replaced 'Mrs' with 'Miss'. In both notices, it substituted wording describing unsupported chimney sections at the front and rear of the property and stating that there was a risk of local collapse of the chimney structures and falling masonry, leaving the property structurally unstable or unsafe.
The judgment also set out directions about a possible costs application. The appellants were ordered to provide documents by 30 August 2023 if they opposed an oral costs application, and the respondent was directed to confirm by 13 September 2023 whether a written costs application would be pursued.
