Tribunal's reasoningThe tribunal struck out the claims after Mr Redman failed to attend the final hearing on 29 June 2023. An order was made giving him until 4:00 p.m. on 7 July 2023 to provide a satisfactory explanation, but he did not make representations that satisfied the tribunal.
The tribunal found that Mr Redman was aware of the hearing. He had telephoned the tribunal on 25 April 2023 and was told that correspondence, including notice of the 29 June hearing, had been emailed to him on 9 March 2023. He confirmed that the email address held by the tribunal was correct, and the tribunal found that the notice had been sent to that address. The tribunal also noted that he emailed the respondent on 26 June 2023 effectively reminding it that the tribunal hearing was taking place on 29 June, and that the video-hearing link had been sent in advance to the correct email address.
When Mr Redman telephoned the tribunal clerk on the morning of 29 June in response to a message left for him, he said that he “knew nothing” about the hearing. The tribunal rejected that account as untruthful in light of the earlier email to the respondent and the surrounding correspondence. It also recorded that he had taken no steps during the proceedings to comply with directions, including disclosure of documents, provision of a schedule of loss, or service of a witness statement.
On that basis, the tribunal concluded that Mr Redman had no intention of participating in the proceedings or was wilfully ignoring them, and it struck out the claims accordingly.
