At the 3 June 2025 CVP hearing, the respondent did not appear, was not represented, and had not filed a response. The tribunal referred to Rule 22(2) of the Employment Tribunal Rules and determined the holiday pay and unauthorised deduction of wages claims on the evidence before it.

Ms Bellwood's holiday pay claim was allowed. The tribunal found that the relevant holiday period ran from 1 January 2024 to 31 December 2024, that her annual salary was £16,255.20, her daily rate was £62.52, and that 30 days' holiday produced an entitlement of £1,875.60.

Mr Brumfitt's and Mr Stead's unauthorised deduction of wages claims were also allowed. The tribunal found that they were last paid on 30 November 2024, presented their claims on 2 January 2025, and were each claiming 33 days' pay on an annual wage of £22,308.00 and a daily rate of £61.12, producing £2,016.96 each. The claims for redundancy pay and notice pay were adjourned because the tribunal said it was unclear whether the claimants had been dismissed, and it directed them to take advice for the adjourned hearing. The tribunal also noted pension sums but said they appeared not to be within its jurisdiction.
