Mr J Hope and 8 ors v 1) Wyke Printers Limited (in Creditors Voluntary Liquidation) 2) Secretary of State for Business, Energy & Industrial Strategy — 2021

At Leeds by Cloud Video Platform on 22 September 2021, Employment Judge Bright with Mr Mohammed Taj and Mr Neil Pearse heard linked claims by Mr J Hope and others against Wyke Printers Limited (in Creditors Voluntary Liquidation) and the Secretary of State for BEIS. Claim 1802168/2021 was dismissed on withdrawal as a duplicate of another claim. The tribunal also held that claim 1802806/2021, brought by Mr Cosway, was not presented in time but should be entertained because it was not reasonably practicable to present it earlier and it was presented within a further reasonable period.

The tribunal upheld unlawful deduction from wages claims for Mr Mulligan, Mr Bird, Mr Platten, Mr Cavany, Mr Hope, Mr Brown and Mr Cosway and ordered payment of £349.26, £37.66, £139.42, £238.70, £189.42, £660.00 and £189.92 respectively.

It also upheld breach of contract claims for unpaid holiday pay on termination for Mr Mulligan, Mr Bird, Mr Platten and Mr Cavany, awarding £1,147.67, £753.12, £1,135.49 and £1,077.67 respectively. Finally, the tribunal found the section 189 TULRCA 1992 complaint well-founded for failure to comply with section 188 and made a protective award for a 90-day protected period beginning on 18 December 2020, with the Recoupment Regulations applying, for the claimants identified in the schedule including Mr S Harry and Mr D Lambert.
