After waiting and attempting to contact the respondent, and noting the circumstances concerning the respondent's name and address on correspondence, the tribunal decided to hear the case in the respondent's absence.
The unfair dismissal claim was withdrawn by the claimant and dismissed for want of jurisdiction. The tribunal found that the claimant had been employed from 1 October 2018 until 1 April 2019 and did not have the necessary qualifying period for an unfair dismissal claim.
On notice pay, the tribunal accepted the claimant's account that, after an argument about lateness, the respondent told him to get his belongings and leave, and found that he had been dismissed. It awarded one week's notice pay of £227.07. The tribunal also awarded £372.69 for nine days' holiday pay, calculated under regulation 14(3)(b) of the Working Time Regulations 1998. The minimum wage claim was dismissed because there was no evidence on which to determine it.
