Mr G Johnson v C Perkin Ltd — 2020

Mr G Johnson brought two claims against C Perkin Ltd complaining of non-payment of wages and unlawful deduction from wages. No ET3 response was presented to either claim, and the Tribunal dealt with the matter under Rule 21 on the basis of the material before it. The respondent’s Companies Register status was noted, together with the claimant’s evidence that he had been told the business ceased trading on 17 July 2020 and later went into creditors’ voluntary liquidation on 10 September 2020.

For case no. 1802699/2020, the claimant said that in early March 2020 he was sent home and told not to return to work until notified. The Tribunal accepted that there had been a shortfall in his March 2020 pay in the net sum of £2,253.56 and found that this was an unlawful deduction from wages.

For case no. 1803802/2020, the claimant said he was told orally that he would be put on the Government furlough scheme and would receive 80% pay, subject to the statutory maximum of £2,500 per month. He received £2,500 for April and May 2020, but no payment for June 2020 and no further payment for the first half of July 2020. The Tribunal found unlawful deductions in respect of those sums and ordered payment of the gross sum of £3,750.00. The combined total awarded was £6,003.56.
