Claimant v Petraviciute v Supreme Aesthetics Ltd — 2022

The claimant, Miss V Petraviciute, pursued two unlawful deduction from wages claims. The tribunal recorded that the respondent admitted the May 2022 deduction of £660. It separately considered an April 2022 claim for £432, said to represent 36 unpaid hours at £12 per hour. In assessing that claim, the tribunal compared the claimant's written record, an electronic notebook record, and the claim itself, and noted the respondent had produced no evidence showing the claimant's figures were invented or invalid.

The tribunal accepted the claimant's evidence that her hours were irregular and could exceed the 16 hours per week stated in her contract. It found that the April 2022 figures were wages and that, because they had not been paid, they were unlawfully deducted from wages. Judgment was therefore entered for £432 on the April claim and £660 by consent on the admitted May claim, making a total award of £1,092.

The claims for holiday pay and for 'other payments' were not proceeded with and were dismissed on withdrawal by the claimant. The judgment also records that there had been an unfair dismissal claim, but that claim had been struck out previously and was not determined at this hearing.
