At a preliminary hearing, the tribunal determined that it had no jurisdiction to consider the claimant's complaints of race discrimination. The judgment states that all of those complaints were presented after the expiry of the statutory time limit.

The tribunal also recorded that the claimant expressly refused to advance any contention that it was just and equitable for the time limit to be extended. On that basis, the race discrimination complaints could not proceed.
