Tribunal's reasoningThe tribunal found that Mr Wignall was disabled as defined in the Equality Act from December 2019 onwards. Despite that finding, the complaints of disability discrimination, comprising direct discrimination, unfavourable treatment and failure to make reasonable adjustments, were dismissed as not well-founded.
The tribunal also dealt with complaints of unauthorised deduction from wages relating to holiday pay and pay in October and November 2019. It held that those complaints were brought outside the time limit in the Employment Rights Act 1996, found it was reasonably practicable to present them in time, and concluded that it therefore had no jurisdiction to deal with them. The tribunal added that, even if it had had jurisdiction, it would have found those claims were not well-founded.
A separate complaint of unauthorised deduction from wages for pay due on 3 January 2020 succeeded. The respondent was ordered to pay the claimant £95.56, and the tribunal recorded that the claimant would be responsible for any tax or national insurance.
The complaint of unauthorised deduction from wages in respect of pay for 24 February 2020 was dismissed as not well-founded. The judgment did not record any separate award for the discrimination claims or any further remedy beyond the £95.56 wage payment.
