Tribunal's reasoningMs Marita Hila-Jones did not attend the preliminary hearing on 10 December 2021, and neither did the representative named in her ET1, Mr Robert Stephens, despite notice of the hearing having been sent to him in writing on 29 September 2021. The tribunal therefore made an order at that hearing that unless the claimant showed cause by 7 January 2022 why the claim should not be struck out for failure to comply with the notice and/or because the claim was not being actively pursued, the claims would be struck out.
No communication of any kind was received from the claimant or her representative after the preliminary hearing or after the order. Employment Judge Drake therefore struck out all the claims in the judgment dated 15 February 2022, sent to the parties on 16 February 2022. No remedy was awarded.
