Tribunal's reasoningAt the CVP hearing in Sheffield before Employment Judge Little on 22 April 2021, Miss F Clift succeeded in claims for unfair dismissal, redundancy pay, holiday pay, wrongful dismissal and unauthorised deduction from wages. The tribunal held that she had been dismissed by reason of redundancy, but that the redundancy payment already made had not been calculated correctly.
On unfair dismissal, the tribunal awarded £949.44 for four weeks' lost earnings during a period in which a fair employer would have engaged in consultation, together with £500 for loss of statutory rights. It awarded £237.36 for wrongful dismissal on the basis that the claimant had received the incorrect period of notice or payment in lieu, and £237.36 for holiday pay.
The tribunal also found an unlawful deduction from wages, holding that sums had been withheld on the premise that payment was only due if expenses had been incurred. On redundancy pay, it found that five years' service and a gross weekly pay of £240 produced a total entitlement of £1,200, of which £751.68 had already been paid, leaving £448.32 outstanding. It made a further lower award of £480 under section 38 of the Employment Act 2002, and ordered the sums to be paid forthwith. The total awarded was £3,331.69.
