Tribunal's reasoningThe tribunal decided a preliminary point only. It found that the effective date of termination of the claimant's employment was, at the latest, 4 February 2019. On that basis, the claim presented on 30 July 2019, which included complaints of unfair dismissal, wrongful dismissal and unauthorised deduction from wages, was out of time because the last date for presenting it in time was 3 May 2019.
The tribunal further found that it would have been reasonably practicable for the claimant to present the claim in time and that it was not appropriate to extend time. In those circumstances, the tribunal held that it had no jurisdiction to consider the merits of the claim and dismissed it. No remedy was awarded.
