Tribunal's reasoningThe tribunal held that the respondent had failed to pay the claimant his wages from April 2022 onwards, but the pleaded unlawful deduction claim was limited to the period from April 2022 to 5 August 2022. Counsel for the claimant accepted that the unpaid amount for that period was £13,360.72 gross, made up of four months at £3,208.33 gross per month and five days in August worth £527.40. The respondent was ordered to pay that sum.
A separate aspect of the case concerned sums said to have been deducted for national insurance, tax and pension and then not passed on to HMRC or the pension provider. The tribunal recorded that this part of the case did not proceed: counsel accepted that the national insurance and tax deductions were required by statute, pension payments were not wages for this purpose, and the proposed attempt to recast the matter as breach of contract was not pursued because it was more than a relabelling and was out of time. That aspect was withdrawn and dismissed.
The claim for failure to provide an itemised pay statement was also withdrawn and dismissed. The tribunal noted that the point was out of time and that a declaration on that issue would not assist the claimant.
