The hearing was held remotely by video on 8 March 2021 before Employment Judge K Armstrong. Capital Asset Partners Ltd did not attend and had not presented a response under rule 16, so the tribunal proceeded under Rule 21 after receiving further information from the claimants in writing and at the hearing.

The tribunal awarded the first claimant, Mr A Gibson, unpaid wages, notice pay damages and a redundancy payment. It made the same type of awards to the second claimant, Mr B Brian, and also found that he had been unfairly dismissed; however, because the tribunal found that he would have been dismissed in any event, the compensatory award was reduced by 100% and no separate award was due because a redundancy payment was also made. The third, fourth, fifth, sixth, seventh, ninth, tenth, eleventh and twelfth claimants were also awarded sums for unauthorised deductions from wages, breach of contract notice pay, and in several cases accrued but untaken leave and redundancy payments, with the specific amounts recorded in the judgment.
