This was a Rule 21 preliminary hearing conducted by telephone on 30 April 2021 before Employment Judge JM Wade. The tribunal considered the papers and recorded that the first respondent had failed adequately to comply with section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992.

On that basis, each claimant listed in the attached schedule succeeded in a claim for a protective award under section 189 of the 1992 Act. The tribunal ordered remuneration for a protected period of 90 days beginning on 29 June 2020, described as the date on which the first of the dismissals to which the complaint related took effect.

The judgment also states that any claims by Agley and others not appearing in the attached schedule were dismissed as duplicate claims. No costs order was made, and the judgment does not set out a monetary total or a split of the protective award into separate sums for individual claimants.
