Tribunal's reasoningThe tribunal heard this matter by CVP on 28 January 2021, with Employment Judge Deeley sitting alone. The respondent, Stylex Auto Product Limited, had entered administration on 12 June 2020 and later creditors' voluntary liquidation on 10 December 2020. The judgment records that the respondent operated from Scunthorpe and that staff were made redundant from 12 June 2020 onwards, with further redundancies continuing between 19 June and 18 August 2020 without consultation.
The only claim determined in this judgment was the collective redundancy consultation complaint. The tribunal found that the complaint that the respondent failed to comply with s.188 of the Trade Union and Labour Relations (Consolidation) Act 1992 was well-founded. It therefore made a protective award of 90 days' pay in respect of the claimants named in the attached schedule, and ordered the respondent to pay remuneration for the protected period of 90 days beginning on 12 June 2020.
