Tribunal's reasoningThe Tribunal found that the parties entered into a contract of employment on 11 February 2019, with agreed variations on 19 August 2019 and again on 16 June 2021, or alternatively on 22 June 2021. On either footing, the later variation left the 19 August 2019 terms and conditions unchanged apart from the claimant's hourly rate of pay and working hours. The Tribunal found that the claimant's contractual sick pay entitlement remained governed by clause 11 and that his annual leave entitlement remained governed by clause 10.
On that basis, the Tribunal held that the respondent failed to pay the claimant the contractual sick pay properly payable to him in September 2021. It found that this amounted to an unauthorised deduction from wages and ordered the respondent to pay £773.29 gross, on or before 27 January 2022.
The Tribunal rejected the claimant's complaint so far as it related to holiday pay for the holiday year ended 31 December 2021. It found that there had been no unauthorised deduction from wages in respect of holiday pay, and the complaint otherwise stood dismissed.
