Tribunal's reasoningThis was an interim judgment on statutory redundancy payments. The tribunal recorded that all 18 claimants were summarily dismissed on 4 September 2019 because the respondent's business had either ceased or was imminently about to cease. It was not in dispute that the dismissals were by reason of redundancy, and the respondent did not in principle defend the claims for statutory redundancy payment.
After a preliminary hearing on 3 January 2020, the tribunal ordered the claimants to provide missing information, including dates of birth, and asked the respondent to say whether and why he disagreed with any of the redundancy calculations put forward. The respondent's managing director later wrote to the tribunal disputing some figures, but the judge recorded that he did not explain how he had reached the amounts he proposed.
Using the information supplied about age at dismissal, length of service and gross weekly pay, and applying the calculation method in section 162 of the Employment Rights Act 1996, the tribunal calculated each claimant's statutory redundancy payment. The schedule attached to the judgment set out individual awards ranging from £294.76 to £9,576, with a combined total of £41,890.02.
The judgment also noted that the claimants had other complaints, but those were to be determined at a hearing listed separately in due course.
